1. Who we are
onlychams is a sole proprietorship operated from the United States. These Terms of Service ("Terms") are an agreement between you and onlychams ("we", "us", "our").
- Email: [email protected]
- Support: onlychams.pro/support and our Discord server
These Terms cover the website at onlychams.pro, your account, the store, support tickets, our Discord server, and the license time you buy. The software itself is covered by our End User License Agreement (EULA). These documents are part of these Terms:
- End User License Agreement
- Refund and Cancellation Policy (which also explains billing)
- Acceptable Use Policy
Our Privacy Policy explains how we handle your data. If you are an approved reseller, the Reseller Agreement also applies to you.
By creating an account, buying time, or redeeming a license key, you agree to these Terms. If you do not agree, do not use the service.
2. Read this first: what the product is and the risk you take
Please read this section carefully. It describes the product honestly.
- Our software modifies or assists gameplay in third-party multiplayer PC games. Our current product, Reclaimer, works with Halo, a game owned by Microsoft.
- Using our software breaks the game publisher's terms of service.
- We are not affiliated with, endorsed by, or authorized by Microsoft or any other game publisher or platform.
- Your game account can be suspended or banned at any time by the publisher or its anti-cheat system. We cannot prevent this. We do not promise that the software is undetectable or that you will not be banned. That risk is yours.
- Our public status board shows each product as "undetected", "updating" or "detected". "Undetected" only means we do not currently know of a detection. It is not a guarantee, and the board can lag behind real events.
- A ban can mean losing access to your game account, its progress, and items or content you bought for it. We do not compensate you for that loss. A ban alone is not a reason for a refund. Our Refund and Cancellation Policy explains when you can get a refund.
- You are responsible for checking whether using this kind of software is legal where you live. Do not use the service where it is not.
3. Who can use the service
You may use the service only if all of these are true:
- You are at least 18 years old and can enter a binding contract.
- Using the service is legal for you where you live.
- You are not located in, or ordinarily resident in, a country or region under comprehensive US sanctions, and you are not on a US government list of restricted persons.
- We have not previously banned you from the service, unless we have agreed in writing that you may return.
4. Your account
- You need an account to buy time or redeem a key. Accounts are free.
- Give us accurate information, including the location you state at checkout.
- Keep your password secret. You are responsible for what happens on your account. Tell us right away through support if you think someone else has accessed it.
- You can link a Discord account. This is optional and you can unlink it.
- Your account is personal. Do not sell, share or transfer it.
5. What you buy: license time
- We sell fixed-duration licenses ("time"), for example 1 day, 7 days or 30 days, for a specific product.
- Time is added to your account as soon as the purchase completes, or as soon as you redeem a license key.
- Time keeps running whether or not you use the software. It does not pause when you are offline or not playing. Our Refund and Cancellation Policy explains when we add time back for downtime on our side.
- There is no automatic renewal and no recurring billing. Your time simply expires. Buying more time is a new, separate purchase.
- Your time is tied to your account and to one PC, using a hardware ID. If you change or repair your PC, support will reset the hardware ID on request, once every 7 days. Staff may allow extra resets for genuine hardware changes.
- A license key can be redeemed once. Keys bought from an independent reseller are sold by that reseller, not by us. See section 7.
- We may change, update or stop offering a product. If we permanently stop a product while you still have time on it, our Refund and Cancellation Policy explains what you get back.
6. Prices, payment, store credit and tax
The Refund and Cancellation Policy explains billing in full. In short:
- Prices are in US dollars and are shown before you pay.
- You can pay with PayPal or Litecoin. PayPal hosts its own payment page; we never see your card or bank details.
- Payments are added to your account as store credit in US dollars, and your purchase is paid from that credit. If you pay more or less than the purchase price, the difference stays on your account as store credit. Store credit does not expire, and you can ask for unused credit back.
- At checkout you tell us your country and US state, and if you are in North Carolina, your county and ZIP code. This must be accurate. We add any sales tax or VAT we must collect on your purchase, such as North Carolina sales tax if you are in North Carolina, or VAT if you are in the European Union or the United Kingdom. The tax and the total are shown before you pay.
- If you live in the European Union or the United Kingdom, checkout asks you to agree that delivery starts immediately and to confirm that you lose your 14-day right of withdrawal once it does. Section 11 of the Refund and Cancellation Policy explains this.
7. Keys bought from resellers
Independent resellers buy keys from us and sell them to their own customers at prices they set. If you bought a key from a reseller:
- The reseller is the seller. Questions about your payment, refunds and receipts go to the reseller.
- Once you redeem the key, you use the software under our EULA, these Terms and our Acceptable Use Policy, like any other customer. Our support helps you with loader and technical problems in the same way.
- Resellers are not our employees or agents and cannot change these Terms or make promises for us.
- Keys from a reseller carry the reseller's brand prefix.
- If the reseller who sold you a key is later suspended or its reseller agreement ends, a key you have already redeemed keeps working, unless the key was bought with funds that were fraudulent or later reversed, for example by a chargeback. If we revoke a key for that reason, ask the reseller for a refund.
8. Status board, support and Discord
- The status board is our best current information. It is not a promise.
- Support is offered through support tickets at onlychams.pro/support and through our Discord server. We aim to help, but we do not promise a response time.
- Discord's own terms apply when you use Discord.
9. Content you post
"Your content" means vouches (reviews), support ticket messages, cloud configurations you upload, and anything else you post through the service.
- You keep ownership of your content.
- You give us a worldwide, non-exclusive, royalty-free license to store, copy, display and process your content as needed to run the service. For vouches, this includes showing them publicly on the site with your Discord name and avatar.
- Do not post content you do not have the right to share, or other people's personal information.
- We may remove content, other than vouches, that breaks these Terms or our Acceptable Use Policy. Vouches follow the rules below.
Vouches
- Every vouch shown on the site is a genuine post by a customer about their own experience. We do not write vouches, and we do not show vouches from staff or resellers as if they came from ordinary customers.
- If we give anyone free time or anything else in return for a vouch, we label that vouch as rewarded wherever we show it. We never make a reward depend on the vouch being positive.
- We do not remove or suppress vouches because they are negative. We remove a vouch only if it is spam (including a post that is not from a genuine customer), abusive, or illegal, or if its author asks us to.
- You can ask us to remove your own vouch at any time. Copies on Discord follow Discord's rules.
10. Our property
The site, the loader, the product modules, our name and our logos belong to us or our licensors. These Terms and the EULA give you only the rights they state. Game names such as Halo are trademarks of their owners. We use them only to identify the games our products work with, and that use does not mean the owners endorse us.
11. Copyright complaints
If you believe content on our service infringes your copyright, email [email protected] with: your contact details, the work you say is infringed, where the material is on our service, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate, and your physical or electronic signature. We will review the notice and remove or disable access to material we find infringing. If we remove your content because of a notice, we will tell you, and you can reply through support if you think we got it wrong.
12. Suspension and termination
- You can stop using the service and ask us to close your account at any time.
- We can suspend or close your account, or revoke license keys, if you break these Terms, the EULA or the Acceptable Use Policy, if we reasonably suspect fraud or chargeback abuse, or if the law requires it. Where it is safe and lawful, we will tell you why. If we suspend your account and then find that you did not break these documents, we add back the time lost during the suspension.
- Serious breach. If we close your account for a serious breach, your remaining paid time ends without a refund, unless the law requires one. A serious breach means only: fraud, including paying with a payment method you are not allowed to use; chargeback abuse, meaning disputing a payment for something you received in order to get it for free; sharing or reselling license keys outside the reseller program; attacking our systems; or reverse engineering the software.
- Any other closure. If we close your account, revoke your key or end your paid time for any other reason, including a breach that is not a serious breach or no breach at all, we refund your unused paid time pro rata, as described in the Refund and Cancellation Policy.
- Closing your account never forfeits unused store credit. You can still ask for it back under section 5 of the Refund and Cancellation Policy, except credit from a payment that was fraudulent or was reversed.
- Sections that by their nature should survive, such as sections 9 to 11 and 13 to 17, continue after your account ends.
13. Changes to the service and these Terms
We may update these Terms. If a change is material, we will give at least 14 days' notice on the site, by email if you gave us one, or on Discord, before it takes effect. If you keep using the service after that, the new Terms apply. A change never takes away time you have already bought. If you do not accept a change, you can stop using the service, and if the change materially reduces what you paid for, you can ask for a pro-rata refund of your unused time.
14. Disclaimer
To the fullest extent the law allows, the service, the software and the status board are provided "as is" and "as available". We disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the software will be undetected, that your game account will not be banned, that the service will be uninterrupted or error-free, or that a game update will not stop the software working.
Nothing in this section limits rights that cannot be waived by law, including rights under North Carolina's consumer protection law (N.C. Gen. Stat. Chapter 75) and the statutory rights of consumers in the European Union and the United Kingdom. Where the law does not allow a disclaimer, it applies only as far as the law allows.
15. Limits on our liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special or consequential losses.
- We are not liable for the suspension or banning of any game account, or for losing game progress, items, in-game purchases or the game itself, because that risk is explained in section 2 and you accept it when you use the software.
- Our total liability for all claims about the service is limited to the amount you paid us in the 12 months before the claim arose.
These limits do not apply to liability that cannot be limited by law. In particular, nothing in these Terms limits our liability for fraud, for our willful misconduct or gross negligence, or for death or personal injury caused by our negligence. Nothing in these Terms limits or waives rights that cannot be waived by law, including rights under N.C. Gen. Stat. Chapter 75 and the mandatory consumer protection laws of the country where you live.
16. Your responsibility for misuse
If a third party brings a claim against us that is caused by your breach of these Terms or by your unlawful use of the service, you agree to cover the reasonable losses and costs we incur because of that claim, as far as the law allows. This does not cover any part of a claim that we caused, or any claim about the software itself or about using it in the way these Terms and the EULA allow. We will tell you promptly about any claim we ask you to cover.
17. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. If you live outside the United States, you may also have protections under the mandatory laws of your country, and these Terms do not take those away.
Before starting any formal claim, please contact us at [email protected] or through support and describe the problem. We will try to resolve it informally within 30 days.
Any dispute that we do not resolve informally will be decided by the state or federal courts of North Carolina, including small claims court where the claim qualifies. You and we agree to the personal jurisdiction of those courts.
If you are a consumer living in the European Union or the United Kingdom, you may also bring a claim in the courts of the country where you live, if your local law gives you that right, and we will bring any claim against you there if your local law requires it.
18. General
- These Terms and the documents listed in section 1 are the whole agreement between you and us about the service.
- If a court finds part of these Terms unenforceable, the rest still applies.
- If we do not enforce a right right away, we have not given it up.
- You may not transfer these Terms or your account. We may transfer them to someone who takes over the service, and we will tell you if that happens.
- We may communicate with you electronically, through the site, by email or on Discord.
- We are not responsible for delays caused by events outside our reasonable control. This does not reduce what the Refund and Cancellation Policy gives you.
